We provide the Policy explaining our online information practices, so that you can decide whether and how to interact with the Site.
Interpretation In construing or interpreting the terms of the Policy: (i) the headings in this Policy are for convenience only, and are not to be considered, and (ii) no presumption is to operate in either party’s favor as a result of its counsel’s role in drafting this Policy.
User understands that through his or her use of the Site, User consents to the collection and use (as set forth in the Policy) of the information, including the transfer of this information to the United States and/or other countries for storage, processing and use by the Site. The Site may make certain communications to some or all Users, such as service announcements and administrative messages. These communications are considered part of the services and a User’s account with the Site, and Users are not able to opt out of all of them.
Your Host, or Hosts if are there more than one, will have access to your name, email address, and all personal or contact information that you provide when you register. The Host will also have access to Data regarding your usage activity, in both aggregated and personally identifiable forms. Hosts will be able to see aggregated Member activity within the Site, as well as specific information like how many people cheered in response to a comment you made. Your Host also will be able to associate Your Content, and any Personal Information it contains, with your contact information. If you agree, Hosts may communicate with you outside of the Service about the Mighty Network or relevant topics of interest to you, and may retain your personal information after you leave the Mighty Network. Don't join if you are not comfortable sharing your personal information with the Host of that Mighty Network.
Members, Hosts and Moderators may not live inside Canada and therefore, they will interact with the Site from jurisdictions outside of Canada. Like other platforms such as LinkedIn and Facebook, the Site is accessed by people anywhere in the world who are a member.
If you object to Member, Host or Moderator accessing the platform from outside of Canda, your sole remedy is not to join the Site or to leave the Site if you have joined.
Users must provide a valid email address to the Site, at which email address the User can receive messages.
User must also update the Site if that email address changes.
The Site reserves the right to terminate any User account and/or User access to the Site if a valid email is requested but is not provided by the User.
Users agree not to pick a username or provide any profile information that would impersonate someone else or that is likely to cause confusion with any other person or entity.
If the Site allows comments or User input, or prompts or allows a User to create an avatar or upload a picture, User agrees not to use any image that impersonates some other person or entity, or that is otherwise likely to cause confusion.
You are responsible for protecting your username and password for the Site, and you agree not to disclose it to any third party. We recommend that you use a password that is more than eight characters long. You are responsible for all activity on your account, whether or not you authorized it. You agree not to disclose your password to anyone. You agree to inform us of unauthorized use of your account immediately, by email to Herlegalglobal [at] gmail.com. The Site disclaims all liability arising from the failure to keep a password secure.
You acknowledge that if you wish to protect your interactions with the Site, it is your responsibility to use a secure encrypted connection, virtual private network, or other appropriate measures. The Site’s own security measures are reasonable in terms of their level of protection.
The Site reserves the right to cancel a User account or to change a username or profile data at any time at our sole discretion and without notice.
The Site has access to the personal data that you use to sign up with including your name, email address and location. If you sign in with either your Facebook or LinkedIn profile, information from that profile will be visible in the Site.
In addition, your participation in the community will include the provision of personal data. This data is not removed from the community by the Site.
Member location is provided as part of the Site in order to facilitate meeting women in your area.
The Policy does not apply to any personal data collected outside of the Site such as during a phone call or from an email. The Policy also does not apply to any unsolicited information you provide to the Site, such as information posted to any public areas of the Service, any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and the Site is free to reproduce and use such Unsolicited Information without limitation or attribution or additional consideration of any kind. The Site respects your copyright as outlined in the Terms.
As part of our General Data Protection Regulation (GDPR) compliance effort, we are providing you with this summary of how you as a User can control how we collect, use and share your personal data.

Any claims brought under or in connection with EU Data processing shall be subject to the Terms, including but not limited to, the exclusions and limitations set forth in the Terms and shall be governed by and construed in accordance with governing law and jurisdiction provisions in the Terms, unless required otherwise by applicable Data Protection Laws.
No one other than a party to the Terms and Policy, its successors and permitted assignees shall have any right to enforce any of its terms.
The User agrees that the Site may engage Subprocessors to process Site Data on Site’s behalf.
If User objects to the use of a Subprocessor, the User’s only remedy is to stop using the Site.
The Site may modify or supplement this section of the Policy referring to the EU Data Processing Addendum, with reasonable notice to the User: (i) If required to do so by a supervisory authority or other government or regulatory entity; (ii) If necessary to comply with applicable law; (iii) To implement new or updated Standard Contractual Clauses approved by the European Commission; or (iv) To adhere to an approved code of conduct or certification mechanism approved or certified pursuant to Articles 40, 42 and 43 GDPR.
In addition to the information collected and used by Mighty Networks, the Site collects certain user information, which may include a username and password, contact information, or any other data that you type in to the Site. At our discretion, the Site may use this data to:
PII does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.

We use PII to customize the Site, to make appropriate service offerings, and to fulfill buying and selling requests on the Site. We may also use PII to contact Users in response to specific inquiries, or to provide requested information. Your consent to the use of your PII is provided when you join the Site and is based on accepting the Terms and Policy. This consent applies to any additional information you provide to the site.

In addition to our direct collection of information, our third party service vendors (such as payment processors, credit card companies, clearinghouses and banks) who may provide such services as credit, insurance, and escrow services may collect this information from our Users. We do not control how these third parties use such information. Some of these third parties may be intermediaries that act solely as links in the distribution chain, and do not store, retain, or use the information given to them.

We may contract with third-party service providers to assist us in better understanding our Site visitors.

How does the Site use login information?
The Site uses login information, including, but not limited to, IP addresses, ISPs, and browser types, to analyze trends, administer the Site, track a user’s movement and use, and gather broad demographic information.
Users may contact us to update PII about them or to correct any inaccuracies by emailing us. However, we reserve the right to contact Users to confirm the request for modification of PII.
While we take commercially reasonable measures to maintain a secure Site, electronic communications and databases are subject to but not limited to errors, hackers, tampering, break-ins, malware, viruses, and trojans and we cannot guarantee or warrant that such events will not take place and therefore you agree that we are not liable for any such occurrences.
The day to day control of PII is governed by this policy.
An individual who requests to have PII deactivated will have this information functionally deleted, and we will not sell, transfer, or use PII relating to that individual in any way moving forward. However, we reserve the right to confirm the identity of any person seeking PII prior to complying with an access request. Requests can be emailed.
